Terms and conditions for 30 and 60 Minute experiences 2016

Above all we want you to enjoy your experience, but as we’re sure you can understand we have to ensure the experiences run safely, and that our cars are looked after and driven sensibly.

Drive SW Ltd is committed to ensuring that all its customers enjoy driving experiences of the highest quality, which are safe, exciting and value for money. Whether a novice driver or experienced professional we want you to feel welcome and enjoy listening to our instructors in the best vehicles and pleasant surroundings. We know how much our customers enjoy their driving experiences so our terms and conditions have been carefully written to ensure that there are no misunderstandings, which could detract from your enjoyment. We recommend that anyone purchasing or booking their experience takes time to read the terms and conditions in full.

General Terms and Conditions:

The experiences are being run by Drive Southwest (Drive SW Ltd). As we work with 3rd party venues for our experiences, dates can be subject to change.

Your experience will be accompanied by a member of Drive Southwest staff, you (the driver) will be driving and a member of staff in the passenger seat. You will be expected to listen and adhere to everything that is said to you by the member of staff for the duration of your experience.

Experiences start at 30 or 60 minute intervals and you will be expected to arrive at the specified location at least 20-30 minutes before your experience starts. Failure to arrive on time may result in your allocated time slot being moved or postponed. You must contact us immediately if you think you may be late or unable to attend on the day.

The route selected is a road route using roads close to and around the selected venue. No deviation of this route will be accepted, unless any obstructions (roadworks, road closures etc) prevent us from using the pre-planned route. Route details available on request.

Normal road driving laws, rules and regulations apply on our 30 & 60 minute experiences. The driver will be liable for any speeding fines should they be caught doing excessive speed.

You will automatically be covered by our insurance policy providing you fit age & licence criteria outlined in the booking process. We will produce a printed copy of the terms and conditions, which you will be expected to sign on the day, as well as being able to provide your card driving licence, pass the new online check (done on the day) plus passport for ID purposes. Should a card licence not be present, or you have not been issued with one, we are able to undergo an online check to confirm your licence requirements.  You MUST notify us in advance if you do not have a card licence so that we can perform this check in advance of the event.

No refund will be given for cancellations on the day, Drive Southwest will endeavour to reschedule wherever possible but no guarantees can be made. All experiences must be pre booked and paid for in advance by online voucher purchase.

No changes or amendments will be accepted on the day, unless otherwise stated/accepted by a member of Drive Southwest staff.

Drive Southwest reserves the right to cancel or postpone the driving experiences should we deem that road conditions or weather conditions on the day would make the experience unsafe. If this is the case, Drive Southwest will offer to re-arrange the experience on the next available date, or offer a refund. You will be notified of any cancellations as soon as possible.

Drive Southwest reserves the right to refuse any driver, without recompense, if we believe they are under the influence of alcohol or drugs, or deemed unfit to drive.

We will ask you to confirm that you are not suffering from any illness or disability whether permanent or temporary or otherwise which is likely to affect your control of the vehicle being driven.

Drive Southwest reserves the right to refuse, without recompense, any driver who is unable to provide the documentation required, or, has given false information about their driving history, licence or identity

We request that the driver has a good understanding of the English language to ensure instructions given by the instructor are understood. We reserve the right to change your experience to Passenger Laps should no understanding of the instructions be demonstrated.

Should the vehicle break down during the experience, Drive Southwest will endeavour to fix the car suitably on the day, or, should this not be possible, will re-schedule your experience or offer a refund.

Any damage caused by the driver to the vehicle through carelessness, or wreckless driving, or through not following given instructions by any member of Drive Southwest staff whilst driving, will be charged at cost to the driver. Should a full insurance claim be required as a result of an accident caused by the driver, the driver will be responsible for the excess of the vehicle which is £1500 for Mustang & Porsche Boxster, £2500 for Aston Martin & GT-R, £5000 for Ferrari and Lamborghini.

Force Majeur

Drive SW Ltd is not liable for failure to perform it’s obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.

Weather

From time to time some of our experiences may have to be cancelled or suspended due to adverse weather conditions, reasons beyond our control or occasionally mechanical breakdowns. Our experiences do continue in the rain. Drive SW Ltd will not be responsible for any accommodation, travel or incidental expenses incurred by customers and every effort will be made on the day for your event to continue, even if the time scale is over and above expected booked time or we will offer you an alternative. Drive SW Ltd reserve the right to offer an adequate alternative car or date where necessary. Once you have booked your experience you are bound by the relevant supplier’s terms and conditions and these will be implemented and adhered to at all times.

You will be given a copy of these terms and conditions on the day, and will be expected to sign a copy confirming you accept.
